GENERAL TERMS OF USE OF THE ONLINE SHOP AT WWW.WESTWING.FI
The following are our General Terms of Use (hereinafter referred to as "GTC"), which we use as the basis for the use of the Westwing online shop on the website www.westwing.fi. By placing your order, you accept the GTC of Westwing GmbH, Moosacher Str. 88, 80809 Munich, Germany (hereinafter referred to as "Westwing").
These GTC are applicable to consumers with a billing address in Finland who purchase goods from our website. For the purposes of Finnish Consumer Protection Act (38/1978, as amended), a consumer means any natural person who acquires a consumer good or service primarily for a purpose other than trade carried out by the natural person.
1. GENERAL AND SCOPE
1.1 Westwing operates an online shop on the website www.westwing.fi.
1.2 To use the offers available in the online shop, persons must be over 18 years of age.
1.3 In principle, goods and services will only be sold in quantities that are customary for households.
1.4 These GTC apply to all contracts concluded via the website www.westwing.fi, unless the General Terms and Conditions for the Use of the online shop at www.westwing.fi by entrepreneurs apply.
1.5 If (working) days are specified as deadlines, these shall be understood to be all working days with the exception of Saturdays, Sundays as well as Finnish and German public holidays.
2. USE OF THE WWW.WESTWING.FI WEBSITE AND REGISTRATION
2.1 When placing an order for goods, you will be asked to provide personal data which will be collected and processed in accordance with Westwing's privacy policy. Section 19 applies to the processing of your personal data.
2.2 You are responsible for the completeness and accuracy of the data. You are also obliged to keep your data up to date. If there is a change in the data provided during your use of the website, you must correct the information immediately. You are obliged to treat your passwords and any other access data confidentially and to protect them from access by unauthorised third parties.
2.3 You are solely responsible for the content (such as product reviews) that you post in the areas accessible for this purpose. You warrant that your own content does not infringe or violate the rights of third parties (including, for instance, copyrights or personality rights relating to name, image or reputation). In this respect, you fully indemnify Westwing against all claims of third parties upon first request. By submitting content to Westwing, you grant Westwing and all affiliated companies of Westwing in the Westwing Group (hereinafter referred to as the "Westwing Group") all simple, unlimited rights of use in terms of time, space and content, and also for the transfer to third parties, which Westwing requires for publishing and distributing the content, even only in part, on the websites of the Westwing Group.
2.4 In your customer account you can view and, if necessary, modify your open, recently sent and/or completed orders, as well as manage and store your own data, vouchers, newsletters and notifications separately.
2.5 You may only register with one customer account on the website www.westwing.fi and you may only operate with one customer account at a time. If Westwing detects multiple registrations, Westwing may delete them.
2.6 It is prohibited to use the website www.westwing.fi or its contents for illegal or abusive purposes or for purposes prohibited by these GTC. In particular, it is not permitted to disrupt or manipulate technical processes. In case of unjustified conduct or attempts to gain unjustified advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the customer's account and not to accept orders.
2.7 Westwing reserves the right to exercise its virtual domiciliation rights at its own discretion and, for example, to issue warnings, refuse orders, restrict the available payment methods, suspend or terminate access to the website www.westwing.fi or the membership or remove transmitted contents if the provisions of these GTC are violated or if an abuse of rights occurs. Your right of withdrawal in accordance with Sections 12 and 13 shall not be limited in any way by the aforementioned measures. Claims for damages by Westwing remain unaffected.
3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 The contracting party when concluding contracts on the website www.westwing.fi is Westwing.
3.2 The website www.westwing.fi operates in the Finnish and English language. Contracts via the website shall be concluded exclusively in the Finnish language.
3.3 After the selected products have been placed in the virtual shopping cart and the electronic ordering process has been completed, you conclude a legally binding contract by sending an order for the goods and services in the virtual shopping cart at that time by clicking the "Buy now" button. After submitting your order, you will receive an e-mail from Westwing confirming receipt of your order.
3.4 Westwing stores the order data and sends it to you by email after placing an order. This email also contains a cancellation policy. You can also download the GTC at any time at https://www.westwing.fi/i/terms_and_conditions/ at any time. If you have created a customer account before submitting your order, you can always view the order data in the login area. This also applies to previous orders within the scope of legal retention obligations.
3.5 The order processing and contact is normally carried out via automated order processing or by email. You must ensure that the email address you provide for order processing is correct, so that emails sent by Westwing can be received at this address. In particular, if you use spam filters, you must ensure that all emails sent by Westwing or third parties commissioned by Westwing to process your order can be delivered.
4. PRICES AND SHIPPING COSTS
4.1 For orders of goods and services on the website www.westwing.fi, the prices indicated on the detail page of the relevant item at the time of ordering shall apply. The prices are total prices including VAT and packaging. Delivery costs and, where applicable, the costs of an Assembly Service that may be booked additionally (see Section 5) shall be added.
4.2 The product prices of the products in your virtual shopping cart will always match the current price on the product detail page. This means that the current product price may differ from the price at which you added the product to your virtual shopping cart. When you add a product to your virtual shopping cart, you don't reserve the price displayed at that time. The price of a product can go up or down between the time you add it to your virtual shopping cart and the time you actually buy it.
4.3 Shipping costs are charged separately for each order and are based on the price indicated on the product detail page. This depends, among other things, on the size, weight and the respective shipping method. The latter is at the discretion of Westwing.
5. ASSEMBLY SERVICE
5.1 For certain products, assembly or installation at the desired location is offered as a separate additional service for a fee in all areas of Finland (hereinafter referred to as "Assembly Service"). If you wish to have the product assembled in such a case, please order the Assembly Service by ticking the "Assembly Service" field on the item detail page, placing the item in the virtual shopping basket and completing the order by clicking the "buy now" button. You can also book the Assembly Service at a later date by selecting a delivery date and ticking the "Assembly Service" box.
Westwing does not guarantee that the goods can actually be mounted or fixed in the spaces provided for this purpose. Westwing reserves the right not to offer the Assembly Service in individual cases if there are objective reasons for this. The Assembly Service is carried out in accordance with the respective assembly instructions.
5.2 Westwing shall provide the Assembly Service itself or through third parties (subcontractors) acting on behalf of Westwing at its choice. You are not entitled to select a specific person to perform the desired Assembly Service.
5.3 Unless you have already agreed on a delivery date via the quotation website, Westwing or a subcontractor of Westwing will contact you to arrange an appointment after you have placed your order. For the provision of the Assembly Service, a suitable and easily accessible environment must be guaranteed, supported by reasonable cooperation on your part, to the extent necessary (e.g., allowing access, sufficient space for assembly).
5.4 Excluded from the Assembly Service are painting and wallpapering work and/or electrical installations, as well as wall and ceiling installations or any other work that may be expressly indicated on the website.
5.5 When ordering the Assembly Service, additional costs to the purchase price will be charged for this Assembly Service according to the price displayed when placing the order or on the appointment booking website.
5.6 The risk of accidental loss and accidental deterioration of the goods shall not pass to you until the Assembly Service has been completed, and the goods have been delivered.
5.7 Westwing and its subcontractors are entitled to carry out an acceptance inspection after the Assembly Service and to produce visual material for documentation purposes.
6. TERMS OF PAYMENT
6.1 You can pay for the goods and services by one of the following payment methods: Apple Pay, Paypal, MobilePay, Trustly, credit card (VISA, Mastercard, American Express), and Klarna.
6.2 We use the payment service provider Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands, to process payments on our website. Mollie offers, among other things, the Trustly payment method. When processing payments, the payment details you provide (e.g. IBAN, name, invoice amount) are passed on to Mollie. You can find more information about Mollie's data processing in its privacy policy: https://www.mollie.com/fi/privacy.
6.3 In case ApplePay or MobilePay (only for web browser orders) is selected as payment method, the payment will be processed by our payment service provider Stripe Payments Europe Ltd (registered in the Irish Companies House under number 3206488LH).
6.4 If a payment method offered by PayPal is selected, the payment will be processed through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (registered in the Commercial Register under number R.C.S. Luxembourg B 118 349), subject to the PayPal User Agreement, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.
6.5 Westwing accepts several credit cards, currently: VISA and Mastercard as well as American Express. Westwing will charge your credit card after receipt of your order via our payment service provider Stripe Payments Europe Ltd (registered in the Irish Companies House under number 3206488LH).
6.6 If Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (registered in the Swedish Commercial Register under number: 556737-0431) is used as a means of payment, the following payment options are available to you if you have the appropriate credit rating: purchase on account with payment within 30 days, payment in three interest-free instalments or financing with interest. In this case, Westwing assigns its credit to Klarna.
7. INVOICING
7.1 By accepting the GTC, you agree that Westwing may send you the invoice by electronic means or make it available to you by electronic means, in accordance with Article 232 of Council Directive 2006/112/EC and the relevant provisions of the Finnish Value Added Tax Act (1501/1993, as amended from time to time).
7.2 Please note that if your data are not correct according to Section 2.2 when ordering, we may no longer be able to issue a correction invoice in order to correct your data after your order is completed. You can correct your data yourself in your customer account or by emailing Westwing’s customer service.
8. VOUCHERS
8.1 Westwing offers various types of vouchers: gift vouchers and allowance vouchers:
8.1.1 Gift vouchers
8.1.1.1 Gift vouchers are vouchers that can be purchased in the Shop and redeemed only at www.westwing.fi, unless otherwise stated on the voucher. The gift voucher will be sent to you by email after placing the order.
8.1.1.2 Gift vouchers and remaining balances of gift vouchers are redeemable until the end of the third year after the year of purchase of the gift vouchers.
8.1.1.3 Gift vouchers can only be used for the purchase of goods and services and not for the purchase of other gift vouchers.
8.1.1.4 If the price of your order is higher than the balance of a gift voucher, you can make up the difference using the payment methods offered. If the price of your order is less than the balance of a gift voucher, you can redeem the remaining balance with your next order.
8.1.1.5 In the event of cancellation of a contract, for whatever reason, the purchase price will be refunded by debiting the voucher account as well as the means of payment used in addition, if any.
8.1.1.6 The gift voucher is transferable.
8.1.1.7 Lost vouchers, especially stolen vouchers, will not be refunded. Westwing assumes no responsibility for the loss of codes.
8.1.2 Compensation vouchers
8.1.2.1 Compensation vouchers are vouchers that cannot be purchased but are issued by Westwing at its discretion as compensation without recognition of any legal obligation.
8.1.2.2 Compensation vouchers, which you receive once for registering on the website www.westwing.fi, can only be redeemed once per customer account.
8.1.2.3 Only one compensation voucher can be redeemed per order. It is not possible to refund or credit the remaining balance of a compensation voucher that arises if the value of the purchase is less than the value of the voucher.
8.1.2.4 The compensation voucher is non-transferable, non-refundable and non-redeemable if you return the goods or services paid for in full or in part with the voucher under the statutory right of withdrawal. If you return ordered goods proportionally, the value of the voucher will be distributed proportionally among the ordered goods, i.e. in case of return of individual items, the voucher will be credited proportionally to the price of the returned goods and will expire proportionally to the value of the goods. If a voucher is linked to a minimum order value, this must also be reached in the case of a partial return of the goods, otherwise the crediting of the voucher value shall not apply.
8.2 Westwing may, in case of justified suspicion of fraud or other activities contrary to law or conditions in connection with the purchase or redemption of a voucher, block the respective voucher code (also temporarily) or refuse the redemption (also temporarily). In the latter case, you are entitled to cancel the order.
8.3 Payment of the voucher amount is not possible, nor is a value transfer or subsequent offsetting for purchases already made, i.e. before the order process has been completed.
8.4 The aforementioned vouchers can only be redeemed by consumers.
9. DELIVERY AND SHIPPING CONDITIONS
9.1 Deliveries will only be made within Finland to the delivery address provided by you.
9.2 The basic delivery times are communicated to you on the detail page of the respective item.
9.3 The ordered goods will be sent as a parcel or by freight forwarder at Westwing's discretion.
9.4 Westwing cannot be held liable for the non-performance or defective performance of Westwing's obligations under this contract if and insofar as this is due to the occurrence of force majeure, notwithstanding that Westwing will do everything in its power to minimise the consequences of such an event.
Force majeure shall mean any unforeseen event or events which, although foreseeable, are beyond the control of Westwing and the effect of which on the performance of the contract could not have been avoided by reasonable efforts on the part of Westwing. This includes, but is not limited to, war, warlike conditions, revolt, rebellion, military or civil coup, insurrection, riot, mutiny, embargo, government order, fire, flood, storm surge, hurricane or other severe weather phenomenon on the scale of a catastrophe, earthquake, lightning strike, pandemic, epidemic, nuclear hazard or similar cause which is beyond the control of Westwing and which renders illegal, impossible or commercially impracticable the execution or performance of the obligations governed by these GTC. If a case of force majeure occurs, Westwing is obliged to inform you immediately. Westwing is released from its performance obligation for the duration of the event. Delivery and performance deadlines are extended accordingly. If the force majeure lasts longer than 8 weeks, Westwing and you are entitled to withdraw from the contract.
9.5 If the delivery of the goods fails for reasons for which you are responsible, Westwing will charge you for the costs of a new delivery as well as reasonable storage costs from the day of the failed delivery. You will be charged for a new delivery even if the first delivery was free of charge for you. We will inform you of the additional costs before the redelivery and will only make the delivery with your consent. Please note that refusal of acceptance does not constitute an effective exercise of your right of withdrawal and must be expressly declared to Westwing. Westwing reserves the right to withdraw from the contract if you do not accept a new delivery within 7 days. In this case, Westwing will reimburse the payments already made by you. This also applies if you actually exercise your right of withdrawal. In this case, you will also be reimbursed the shipping costs (standard shipping).
10. WARRANTY, LIABILITY AND TRANSPORT DAMAGE
10.1 The mandatory provisions of the Finnish Consumer Protection Act concerning the statutory liability for defects shall always apply. 10.2 Notwithstanding mandatory statutory provisions, such as liability under the Finnish Product Liability Act, the Finnish Consumer Protection Act or other mandatory laws under which the liability cannot be effectively limited by contract, Westwing's liability is limited to cases of gross negligence or intentional misconduct on the part of Westwing.
10.3 The above limitations of liability shall not apply if Westwing has fraudulently concealed the defect or has assumed a guarantee for the goods.
10.4 If the goods are delivered with obvious damage to the packaging or contents, we kindly ask you to immediately submit a complaint to the respective courier company and to contact Westwing's customer service (service@westwing.fi). The notification has no effect on your warranty claims but makes it easier for Westwing to assert its rights against the courier company.
11. GUARANTEES
11.1 An additional commercial warranty is only available if it is explicitly stated and described on the product details page. In no event shall the additional commercial warranty affect your rights under the statutory liability for defects concerning the goods.
12. CONSUMER RIGHT OF WITHDRAWAL
12.1 You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party appointed by you, other than the carrier, has taken possession of the goods.
12.2 To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter or an e-mail). You can use the following model withdrawal form, but it is not mandatory:

13. CONSEQUENCES OF WITHDRAWAL
13.1 If you have withdrawn from the contract, we will reimburse to you all payments we have received from you, including the costs of delivery, without undue delay and at the latest within 14 days from the day on which we have received the notice of withdrawal from the contract. For reimbursement, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you. In no case will you be charged for this refund. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, depending on which condition is met first.

13.3 The deadline is met if you send the goods before the deadline of 14 days. We shall bear the costs of returning the goods. You shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.
13.4 The right of withdrawal does not exist or expires for the exceptions mentioned in Chapter 6, Section 16 (1) of the Finnish Consumer Protection Act.
14. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS
14.1 For all purchases of goods Westwing grants you a voluntary right of return for a total of 30 days from receipt of the goods in addition to and independent of the statutory right of withdrawal according to Section 13. This voluntary right of return granted to you by Westwing allows you to withdraw from the contract even after expiry of the 14-day withdrawal period (see Sections 12 and 13) by returning the goods to Westwing within 30 days after receipt.
However, if you exercise this voluntary right of return after the expiry of the 14-day period for exercising the statutory right of withdrawal, a prerequisite for exercising the voluntary right of return is that you return the goods complete and undamaged in the original sales packaging, unless it has been assembled upon delivery by the Assembly Service. Otherwise, Westwing reserves the right to refuse the return. We point out that you bear the risk of transport when returning the goods within the framework of the voluntary right of return. The voluntary right of return does not apply to the purchase of gift vouchers.
14.2 The refund will be made to the means of payment used by you for payment. If direct debit has been selected as the means of payment, it is not necessary to object to it.
14.3 Your statutory right of withdrawal (see Sections 12 and 13) shall not be affected by the fulfilment of the requirements set out in this Section 14 and shall continue to apply irrespective thereof. Until the expiry of the period of the statutory right of withdrawal, only the legal conditions listed therein shall apply. This contractually granted (voluntary) right of return does not limit your statutory warranty claims, which remain unlimited.
15. reimbursement of delivery and service costs in case of partial WITHDRAWAL
15.1 If you withdraw from the contract only for a part of the goods of an order (partial withdrawal), Westwing will reimburse you the payments for the cancelled goods, including delivery and assembly costs (if not yet assembled). However, if (a part of) the delivery and assembly costs would have been incurred even if you had ordered only the goods for which you did not withdraw from the contract, these are excluded from the refund.
16. RESERVATION OF TITLE
16.1 The goods remain the property of Westwing until full payment has been made.

18. DISCLAIMER FOR HYPERLINKS
18.1 Insofar as www.westwing.fi refers to websites of other providers via hyperlinks, Westwing has no influence on their content, does not adopt them as its own and assumes no guarantee or liability for their content. The respective provider or operator of the pages is always responsible for the content of the pages. As soon as Westwing becomes aware of legal infringements of websites of other providers, the corresponding hyperlinks on www.westwing.fi will be removed immediately.
19. DATA PROTECTION
19.1 We process your personal data in accordance with Westwing’s privacy policy. For further information concerning the protection of your data, you can consult Westwing's privacy policy at https://www.westwing.fi/i/privacy_policy/.
20. RIGHTS OF USE
20.1 The content of this website, including text, graphics, photos, illustrations, images, videos, sounds and software (hereinafter referred to as "Material") is protected by intellectual property rights. Downloading or use for private use is permitted. Publication, transmission, reproduction or any other use of the content/material is not permitted.
20.2 All rights of use of the Material on www.westwing.fi belong to Westwing or our partners. The use of the Material, in any form, without the express written consent of Westwing is prohibited.
20.3 All trademarks used on the website may not be used without the prior written consent of Westwing.
21. ALTERNATIVE DISPUTE RESOLUTION
21.1 You can always submit your dispute in writing to the Consumer Disputes Board, which can make recommendations for resolving the dispute, either online (www.kuluttajariita.fi) or by post to Hämeentie 3, P.O. Box 306, 00531 Helsinki. Before taking the matter to the Consumer Disputes Board, you must contact the Consumer Advisory Services (www.kkv.fi/kuluttajaneuvonta).
22. CHANGES TO THE GTC
22.1 Westwing reserves the right to make changes to the website, rules, applicable terms and conditions, including these GTC, at any time. Your order will be governed by the terms and conditions in effect at the time you place your order, unless a change to these GTC is required by law or government regulation (in which case they will also apply to orders you have previously placed).
23. FINAL PROVISIONS
23.1 Any dispute arising out of or in connection with these GTC or the use of www.westwing.fi shall be governed exclusively by the laws of Finland, excluding its choice of law provisions.
23.2 Any dispute, controversy or claim concerning contract shall be resolved primarily by negotiations between you and Westwing. If you and Westwing are unable to reach an agreement through negotiations, any disputes, disagreements or claims concerning the Agreement shall be settled by the District Court of Helsinki as the court of first instance. In matters concerning your rights under the applicable consumer protection laws you shall, however, always have the right to bring an action against Westwing before a district court in Finland in the jurisdiction in which you are domiciled or habitually resident.
23.3 Should any provision be void or ineffective, the remaining provisions shall remain valid. In place of the invalid or ineffective provisions, the relevant statutory provisions shall apply.
